Criminal Sexual Conduct

Criminal Sexual Conduct is commonly known as rape. It is divided into First, Second and Third degree and can be punished from zero to thirty years depending on the degree, SC Code 16-3-651. Both Derek Enderlin and Susannah Ross have represented numerous individuals charged with criminal sexual conduct. This is an extremely complicated crime and you need an attorney experienced in evidence, including DNA, fingerprints, witness statements, eyewitness identification, and other matters. You also need an attorney experienced in trial procedures. This is one of the most serious crimes anyone can ever be charged with and it carries serious consequences regardless of the degree.

You may be charged with this offense even if you did not have sex with the person or even if you do not even know the person. There are a variety of defenses depending on the facts and circumstances.

You may not only be subject to criminal penalties, you may also be subject to the sexual violent predator act, SC Code 44-48-10, which may subject you to being in prison for the rest of your life. Even if the prosecutor is willing to reduce this charge to assault, it is possible you may still have to register for the rest of your life as a sex offender and still spend the rest of your life in prison. You must have experienced representation from attorneys who are familiar with trying criminal sexual conduct cases. Both Derek Enderlin and Susannah Ross have successfully defended criminal sexual conduct cases and Derek Enderlin has lectured on criminal sexual conduct cases during the annual Public Defender conference and the South Carolina Association of Criminal Defense Lawyers conference. Contact Derek Enderlin or Susannah Ross for attorneys that can help you with this charge.
